MOBILE E-SPORTS® develops, operates and maintains software for the organisation of online video game tournaments and helps organisers create and manage competitions while helping gamers find tournaments to partake in. We are committed to respecting the privacy rights of everyone that uses our services, including visitors and other users of www.mobileesports.org and related websites, applications, services and mobile applications provided by us and on/in which this privacy policy is posted or referenced (collectively, the “Services”). We created this privacy policy to give you confidence as you use the Services and to demonstrate our commitment to the protection of privacy.

WHO CAN ACCESS OUR SERVICES
You are allowed to use our website and services only if you are of the legal age in your country to do so. If you are under the age of 18 then you confirm that you have the agreement of a parent or a guardian to use our services. Using our services means that you are legally allowed to play the games which we organise events for and follow their Terms of Service. Please note that you may not use our services if you are not within the legal age in your country to participate in esports events and if you do not have the consent of a parent or a guardian.
YOUR ACCOUNT AND INFORMATION
As long as you comply with these Terms of Use, we give you a limited, non-exclusive, non-transferable, and revocable license to access and use the Services through a personal computer or mobile device. However, it is important to note that you are not permitted to use, reproduce, modify, publicly display, distribute, create derivative works of, or bypass any technological measures that control access to the Services and/or Materials in any manner. This includes using manual or automatic devices or processes for any purpose. Any rights not explicitly granted in the license mentioned above are reserved and always remain with us. Using the Services and Materials for any purpose other than the express authorization provided in these Terms of Use constitutes a violation of our copyrights and other proprietary rights, and is strictly prohibited. In order to access specific parts of the Services, you may need to create an account (referred to as "Account") through the Services. By using the Services, you consent to the collection and utilization of specific information about you, as outlined in the Privacy Policy, by our Services and its affiliated entities. Moreover, you agree not to create an Account or use the Services if you (i) fail to meet the age restrictions as specified in our Terms of Use, or (ii) have been previously banned or removed from using the Services by MOBILE E-SPORTS®. Any form of toxic behaviour, harassment, or blackmail or a behaviour that we perceive to be so towards the participants of our events or our volunteer staff members will revoke your access to any of our Services. Your only recourse of action is to cease using our Services completely.
You may request deletion of your information at any time, except for the following data:
Device ID: Some tournaments may require you to submit your Device ID (a unique combination of characters to identify the device you are using). This information is required so that we can prevent cheating in our tournaments. This data is accessible by us only and is not shared with any of our users or third-parties and is used for the sole reason to prevent cheating in our tournaments. By participating in tournaments that require this data, you agree that we store this data. Note:
Your Device ID will be stored in clear text for up to 36 months.
You may request your personal data to be deleted as described in our Privacy Policy (Data Deletion Request), however your Device ID will not be deleted until after 12 months since your most recent tournament participation have passed.
After your Device ID is deleted, it will remain anonymized in our database.
Linked Accounts: As part of your registration with us, you may provide us with information of other accounts, such as, but not limited to, "Critical Ops" and "Discord". This data is publicly available and thus we reserve the right to store it permanently.
Tournament Statistics: If you participate in our tournaments, then you automatically agree that we collect statistics related to it, that can be linked to you. This data is stored permanently.
IP Address: By accessing our web services, your IP Address is automatically logged.
TOURNAMENT PARTICIPATION
In order for us to provide fair competitions to our users, we provide all participants with a list of terms ("Rules") for our tournaments. The rules may require you to provide us with personal information or anti-cheat measures, so that we can confirm your identity and ensure that no cheating is taking place. If at any time you fail to send us the required information as described in the tournament rules, you may be disqualified from the tournament and/or be suspended from participation in future tournaments.
We reserve the right to exclude you from participating in our events and tournaments without having to provide a reason.
If you, or any other member of your team is suspected to be cheating in our tournaments, we reserve the right to withhold any prizing to confirm that no cheating has taken place until any investigations have completed.
If you received any prizing in a tournament in which you were confirmed to be cheating, then you are required to return all prizes that you received from that tournament.
In order to provide a fair schedule for all our participants, we may make changes to the schedule during a tournament. Every team may register with at least two substitute players (depending on the tournament setting), however if you fail to be available at a reasonable time then we reserve the right to disqualify you from our tournament.
Claims of Copyright Infringement
If you hold the copyright or represent the copyright owner and believe that content shared by a user on or through our Services infringes upon your copyright, please send a notice to our contact email at emailsupport@mobileesports.org. The notice should include the following information along with supporting evidence of your trademarked content:
A description of the copyrighted work that you believe has been infringed. The URL of the specific location on our website where you find the infringing material. Your address, telephone number, and email address. A statement from you expressing your good faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law. A statement made by you, under penalty of perjury, affirming that the information provided in your notice is accurate, and that you are either the copyright owner or authorized to act on behalf of the copyright owner.
We take any reports of copyright infringement seriously and will make every effort to address the matter promptly by removing any material found to be infringing from our Services.
Limitation of Liability

Additionally, we are not liable for any actions taken by our tournaments or tournament organisers or for any failure in the distribution of prizes. If you are dissatisfied with any portion of our products or services or with these terms and conditions, your sole and exclusive remedy is to discontinue using our products and services. This limitation of liability provision shall survive any termination or expiration of the agreement between you and our Company.
Indemnification
You agree to protect, defend, and reimburse our Company, its affiliates, licensors, suppliers, advertisers, network service providers, business partners, and their respective directors, officers, employees, consultants, agents, and representatives, from any and all claims, actions, proceedings, and suits, as well as associated liabilities, damages, settlements, penalties, fines, losses, costs, and expenses (including attorneys' fees and other dispute resolution expenses) incurred by our Company, either directly or indirectly. This indemnification is applicable to any claims arising from or connected to: (a) your violation or breach of any term in these Terms of Use or referenced policies or guidelines, which includes unauthorized disclosure of personal or confidential information; (b) your use or misuse of the Services; (c) any allegation that any user content or materials you submit to us or transmit through the Services infringe or violate the copyrights, trademarks, trade secrets, or other intellectual property or rights of any third party; and/or (d) the termination of your access to the Services. Any disputes arising from or connected to your use of the Services will be exclusively handled in the judicial district of the United Kingdom, and you agree to abide by the authority and venue of such courts. Severability
If any provision of this agreement is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the validity, legality, and enforceability of the remaining provisions shall not in any way be affected or impaired thereby. The invalid, illegal, or unenforceable provision shall be deemed severed from this agreement, and the rest of the agreement shall remain in full force and effect. Furthermore, to the extent possible, we can in good faith, have any invalid, illegal, or unenforceable provision be replaced with a valid, legal, and enforceable provision that achieves the intended purpose of the original provision.

We have the sole authority to revise these Terms of Use in writing. For your convenience, we may translate these Terms of Use, our Privacy Policy, or any other rules, policies, and procedures related to the Services into other languages. However, in case of any conflict between the English version and a translated version, the English version will prevail and govern your use of the Services. Our company will not be held responsible for any delay or failure to perform our obligations due to circumstances beyond our control. Such circumstances may include unforeseen events or causes like acts of God, war, terrorism, riots, government actions, natural disasters, accidents, strikes, or shortages of resources like transportation, fuel, energy, labor, or materials.
USE OF OUR DATA
You may not store or re-share any data provided by our services. You may not access our data by other means than our Web App, or our Discord Bot.
Tournaments and Prizes
Our platform facilitates the organisation of tournaments and enables organisers to create and manage online video game competitions, while also helping gamers discover and join these tournaments. Each tournament may have unique parameters and rules, all of which are detailed on our website. These parameters include interactions and rankings among participants, communication guidelines, and the potential awarding of prizes, if applicable. By using our Services, you acknowledge and accept these additional parameters and consent to receive communications from the game developer or our Services' representatives. However, it is essential to note that we are not responsible for distributing or awarding prizes or rewards. The responsibility for awarding prizes lies with our Partner (Critical Force Ltd.). Despite offering assistance in prize administration, we do not hold any responsibility for determining eligibility or the actual distribution of prizes or rewards. Please be aware that we cannot guarantee that any tournament organiser, who hosts an event through our Services, will fulfill their commitment to distribute advertised or promised prizes or rewards. Participation in the Services comes with inherent risks, and you agree that MOBILE E-SPORTS® bears no responsibility for any tournament prizes advertised on our website. We maintain that the point of contact for all prizes is to be the captain of the team,(the Captain is known for that role as registered on our system) and any user of our Services understands that they entrust the Captain at their own risk when the Captain receives their prizes or rewards by the game developer, Critical Force Ltd.
TEAM OWNERSHIP
As the owner ("leader", "captain") of a team, you are responsible that your members follow our tournament rules.
If we see a team owner is unfit to lead a team, then we may remove the team owner from their position and transfer ownership to another member of the team.
Legal Disclaimer and Liability Waiver
By participating in any tournament or event organized by MOBILE E-SPORTS®, you acknowledge and agree to the following terms and conditions:
Volunteer Status of Staff Members:
All staff members involved in the organization and management of our tournaments are community volunteers and not employees of MOBILE E-SPORTS®. Accordingly, MOBILE E-SPORTS® does not accept any liability for actions, errors, or omissions made by these volunteer staff members. While we strive to ensure fairness and integrity in all our events, mistakes may occur. MOBILE E-SPORTS® cannot be held responsible for any such mistakes made by volunteer staff members.
Experience and Trust in Staff:
Our volunteer staff members act as staff in various tournaments, including official tournaments organized by the game developers. Their experience and knowledge in managing esports events are valued, but this does not imply any liability on the part of MOBILE E-SPORTS® for their actions.
Decision-Making Process:
Decisions regarding team management, match outcomes, and other tournament-related matters are not made by official members of MOBILE E-SPORTS®. Instead, they are made by the Esports Committee, a collective group of individuals, which may include the game developers & other experienced volunteers. This body is independent from MOBILE E-SPORTS®. By entering our tournaments, you acknowledge that MOBILE E-SPORTS® is not responsible for the decisions made by this group of individuals. Any disputes or issues arising from these decisions are outside the liability of MOBILE E-SPORTS®.
Acceptance of Terms:
Your participation in any event organized by MOBILE E-SPORTS® constitutes your acceptance of these terms. You agree to waive any right to take legal action against MOBILE E-SPORTS® for any issues related to the actions of volunteer staff members or decisions made during the tournament.
